(Rapaport…October 5, 2004) The United States Office of Foreign Assets Control (OFAC)amended on September 23 the reporting regulations involving the importation of rough diamonds into the US in accordance with the Clean Diamond Trade Act and the Kimberley Process Certification Scheme. These amendments include:
• The ultimate consignee in the importation process is responsible for retaining the original Kimberley Certificate accompanying importation into the US.
• The ultimate consignee is required to report the receipt of a shipment of rough diamonds to the relevant foreign exporting authority within 15 calendar days of the date that the shipment arrived at a US port of entry.
• A pending requirement of importers to submit the unique identifying number of the Kimberley Process Certificate on relevant US Customs and Border Protection forms.
• Clarification of the country-of-origin reporting requirements for shipments of parcels of mixed origin rough diamonds.
